ASBESTOS (AMIANTE)

For many years now a government initiative has been in place to try to eradicate the risks to health associated with asbestos. This is primarily with regard to the risk of inhalation of asbestos fibres which can cause cancer and other lung-related illnesses. Asbestos was originally used in the building trade because of its excellent insulation qualities which were both thermal and phonic. This made it ideal for roofing and ceiling material as well as fire protection and chimney linings. Unfortunately, over time, the asbestos products degrade and during this process the dangerous fibres are released into the atmosphere. Initially steps were taken to reduce the health risks to people working with asbestos. It then became obvious that certain buildings containing asbestos in their structure were also becoming a health risk, not just to people living in them but also to those required to work on them.

On 7th February 1996, a law was passed which obliged property owners to have tests performed on their buildings to check for asbestos; particularly in chimney linings, false ceilings and central heating systems where the asbestos was most at risk of deterioration. The initial law mainly concerned commercial premises. This law was modified on 12th Sept 1997 and has been updated on a regular basis since then to accommodate changing practices; and as a result of ongoing research into the problem. It now applies to all buildings including private dwellings. Currently, any building which was constructed before 1st July 1997 must be tested for the presence of asbestos before it can be sold. A further requirement brought in on 1st January 2003 states that only registered and fully qualified technicians in this field can perform such tests and give a full, written report. This diagnostic must be performed and a written report provided before the signing of an initial contract (compromis de vente) can take place. Failure to do this can result in an annulment of the sale. Diagnostic tests concerning asbestos, once performed are valid for 30 years, but a copy of the report must still be provided in the event of a sale. The cost of these tests will vary according to the size of the building and its age but are the responsibility of the vendor. A very rough guide price would be 200 -250 euros for an average 4-bedroomed property. It is sensible to get several quotes before proceeding with any diagnostics or ask advice from your property agent if appropriate.
